Attorney Appealing Court Ruling On Obama's Citizenship

Phillip Berg says he's a lifelong registered Democrat and is more politically aligned with Barack Obama than with John McCain. But he says that if Obama fails to produce his birth certificate by next Tuesday, people shouldn't vote for him.

Berg is the attorney who filed a federal lawsuit, dismissed Friday night, which demanded that Obama produce the birth certificate to the court. Berg is in the process of preparing an emergency appeal to the U.S. Supreme Court.

Berg believes that Obama was actually born in Kenya, and therefore not qualified to be president of the United States. And he believes that there's a good chance that the supremes will agree to hear his lawsuit and will rule before Election Day.

If they do, and find in his favor, it would create, if not the constitutional crisis he envisions, certainly a political crisis for the Democratic Party.

Berg, appearing on News Talk Online on Paltalk.com, is dismissive of independent fact checking organizations that claim they've inspected Obama's birth certificate and find him to be a natural born citizen.

I may be wrong, but doesn't he have to produce his birth certificate in order to legally run?

This guy is a joke.

It's all a part of the neocons attempt to throw as much mud as they can against Obama.

I don't believe him when he says he's a Democrat and it breaks his heart to file this lawsuit.

I believe that Phil Berg has been a Democrat for a long time, probably longer than Obama has been politically active. To cast doubt on his political affiliation is a sign of weakness in any argument against him and the cause that he's supporting.
I listened carefully, not being distracted by text I would say what came over strongly was that if Obama were to produce his birth certificate, not merely a document of live birth, then there would be no problem as long as the said document confirmed that he was in fact a natural citizen of the USA.
So where is the problem?
People can scream and rant as much as they like, but they need to dispel all the speculation by persuading Obama to quiet their fears. Doesn't someone who is planning on being the next President have the responsibilty to establish his qualifications for ALL the citizens to be convinced? Surely he can't expect the blind faith that seems to be a characteristic of the majority of his supporters to be accepted by all. Don't the American public deserve at least that?

Re: Produce "his birth certificate, not merely a document of live birth"

The certificate of live birth IS the birth certificate. If you are saying that there is another document, an ancient piece of paper stored in the records of Hawaii since 1961, there's no evidence of that. Lots of governments have gotten rid of their old paper records.

Obama probably asked the government of Hawaii to send his birth certificate, and they sent the certificate of live birth, which is what they usually send and is a perfectly legal document. It is the document that citizens of Hawaii use to get passports.

And, it is valid. Not only has FactCheck checked it out, but the Government of Hawaii has been asked repeatedly about it, and they say that as far as they can tell, since they only can see the electronic copy of the document, it is valid.

Now, let's turn to the Kenyan allegations. It is alleged that Obama was born in Kenya. What evidence is there for this? Is there a Kenyan birth certificate? No. Is there a record that Obama's mother traveled to Kenya in 1961? No.

All there is is the claim by Berg that he has an audio tape of Obama's Kenyan grandmother saying that she saw Obama's birth in Kenya. BUT Berg has never played that tape to anyone. And, if he did or does, it's an audio tape, so how do you know it is his grandmother.

And I've done a search of Kenyan newspapers and newsagencies. If they suspected that Obama was born in Kenya you would think that they would report it. Not a word.

So we have good evidence that Obama was born in Hawaii and no evidence that he was born in Kenya.

smrstrauss,

There is a short form "Certification of Live Birth" and a long form "Certificate of Live Birth". A man who was born in 1963 in Hawaii posted his on the web. It doesn't look anything like the computerized copy from 2007 posted by Obama at his site --- mainly because it's not the full birth certificate.

Berg isn't making up the fact that for a variety of things you need a certified copy of the birth certificate. Tell Obama to produce this and all will go away. What have I established?

a) There is a certified long form that can be obtained from the state of Hawaii
b) Barack Obama has not posted this or shown it to anyone, let alone all the citizens (registered to vote) to demonstrate that Berg is a nut and Obama is in fact qualified.

Listen, I don't want to be involved in conspiracy theories, etc. But this is indisputable. Show us the birth certificate and we'll all be quiet.

Are you basically saying that I factcheck.org can see it, but I can't? What is there to hide?

And why will he not release his school records? I'll finally sum up my theory:

BARACK OBAMA, regardless of whether he was born truly in the state of HI or not, during his college years said that he was born in Kenya. He did this in order to get scholarship monies through diversity programs and the like. How else was he traveling ot no-travel zones and using an Indonesia passport.

Now, that move has bit him in the rear. What an ironic twist this has got him in.

I'm not certain about what the TRUTH is. All I know is this:

Barack Hussein OBAMA is not forthcoming about his birth, his records in school, about many a thing that are standard, legitimate, and part and parcel to running for the greatest office in perhaps the history of the world. He wants to be President but is not forthcoming?
